These Terms of Service ("Terms") govern your use of our services, including SMS/text messaging (A2P 10DLC), website, software, and related products (collectively, "Services"). Eligibility & Age Requirement

By using our Services, you represent and warrant that you are at least eighteen (18) years of age. Our Services are not intended for, directed to, or knowingly used by individuals under the age of 18. If we become aware that a user is under 18, we reserve the right to terminate access to the Services and discontinue communications immediately.

Message Frequency & Content Limits

1.1 Expected Frequency

We may send up to 4+ text messages per week (promotional + informational). If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

1.2 Message Content Rules

- Messages must comply with all applicable laws and carrier policies (no spam, no unlawful content, no phishing, no prohibited content)

- We will clearly identify ourselves in each message (e.g. "NBG" and/or "National Brokers Group")

- We will not mask, spoof, or misrepresent the sending number

- Messages should include required disclosures and opt-out instructions

User Consent & Opt-In

2.1 Explicit Consent Required

By signing up or opting in (e.g. via web form, checkbox, verbal agreement, or other documented method), you expressly consent to receive text messages from us, including promotional, informational, or transactional messages. You acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

2.2 Purpose of Messaging

Messages may include service notifications, updates, marketing/promotional offers, alerts, reminders, or other content related to our products and services. You understand that message frequency may vary, and message/data rates may apply (see Section 4).

Opt-Out / Unsubscribe

3.1 How to Opt-Out

You can cancel the SMS service at any time. Just reply "STOP" to the number which you received the SMS from. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

4.1 Important Notice

Standard message and data rates may apply per your mobile carrier. You are responsible for any carrier charges incurred. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Liability, Disclaimers & Indemnification

5.1 No Guarantee of Delivery

We do not guarantee delivery, timeliness, or receipt of any message. Carriers are not liable for delayed or undelivered messages.

5.2 Limitation of Liability

To the extent permitted by law, in no event will we be liable for any indirect, incidental, consequential, or punitive damages, or for lost profits or data, even if we were warned of the possibility of such damages.

5.3 Indemnification

You agree to indemnify, defend, and hold harmless National Brokers Group, its officers, employees, affiliates, and agents from and against any claim, liability, loss, damages, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Services or breach of these Terms.

- You are responsible for maintaining the confidentiality of your account credentials

Legal Framework & Dispute Resolution

7.1 Changes to Terms

We may modify or update these Terms from time to time. When we do, we will post the revised Terms and update the "Effective Date." Continued use after changes signifies your acceptance.

7.2 Governing Law

These Terms are governed by the laws of Florida, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or Services will be resolved through binding arbitration in Miami Dade County, Florida, unless prohibited by law.

7.3 Severability & Waivers

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. No waiver of any term is effective unless in writing and signed by both parties.
